These Terms of Service ("Terms") are an agreement between you and Heirloom Lifeline LLC ("Heirloom Lifeline," "we," "us," or "our"). They cover your use of our website at heirloomlifeline.com and, once it is available, the Heirloom Lifeline mobile and web application (together, the "Services"). Sections that apply only to the App are clearly marked.
Please read these Terms carefully. By joining our early-access list or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Who can use Heirloom Lifeline
You must be at least 18 years old and able to enter into a binding agreement to use the Services. If you use the Services on behalf of a family or an organization, you confirm that you have the authority to accept these Terms for them.
2. What Heirloom Lifeline is
Heirloom Lifeline is a dignity-first companion that helps families and caregivers know and stay close to a loved one living with dementia — capturing voice, stories, photos, and memories; grounding the person with familiar faces and comforting media; and keeping a care circle connected. Today, the website offers an early-access waitlist. The App and its features described on our website are in development and will be governed by these Terms when released.
3. Accounts and roles (App)
When the App launches, you may need an account to use it. You are responsible for keeping your login secure and for activity under your account. Roles within a care circle (such as family member or aide) are assigned by an administrator — they are not self-selected — to protect the privacy of the person being cared for.
4. Your content
The recordings, photographs, stories, letters, messages, and other materials you add ("Your Content") belong to you. We do not claim ownership of Your Content.
So that we can operate the Services for you, you grant us a limited license to store, process, display, and transmit Your Content as needed to provide the Services — for example, to save a recording, transcribe it at your request, show it to the family and caregivers you have invited, and (if you choose) include it in a printed Legacy Book. This license exists only to run the Services and ends when you delete the content or your account, except for copies we are required to keep by law or that remain in routine backups for a limited time.
When you add content about another person — including the person being cared for, family members, or aides — you confirm that you have the appropriate authority or consent to do so. You are responsible for Your Content and for having the rights to share it.
5. Acceptable use
Please use the Services respectfully and lawfully. You agree not to:
- upload content you do not have the right to share, or that infringes someone else's rights;
- use the Services to harass, harm, or impersonate others;
- attempt to access accounts, data, or systems you are not authorized to access;
- interfere with, disrupt, or attempt to reverse-engineer the Services; or
- use the Services in violation of any applicable law.
6. Not medical advice or emergency care
Heirloom Lifeline is a supportive companion, not a medical service. It does not provide medical advice, diagnosis, or treatment, and it is not a medical device or a substitute for professional care. Any caregiver resources, helplines, or educational content we provide are for general information only. Always seek the advice of a qualified health professional with any questions about a medical condition, and never disregard professional medical advice or delay seeking it because of something in the Services. In an emergency, call your local emergency number (911 in the U.S.) or a crisis line immediately — the Services are not designed for emergencies.
7. Subscriptions and payments (App)
Some App features and the printed Legacy Book will be offered for a fee. When paid features become available, we will show clear pricing and billing terms before you purchase, including how subscriptions renew and how to cancel. Applicable fees, taxes, and the terms of any printed-book or third-party fulfillment will be disclosed at the time of purchase.
8. Third-party services and links
The Services rely on trusted third parties (for example, for hosting, transcription, email, and payments) and may link to outside resources, such as dementia and caregiver support organizations. We are not responsible for the content, products, or practices of third parties. Links and resources are provided for your convenience and do not imply our endorsement.
9. Our intellectual property
The Heirloom Lifeline name and logo, the tagline "Memories Anchored. Love Never Fades.," and the design, text, and features of the Services are owned by Heirloom Lifeline LLC and protected by intellectual-property laws. "Heirloom Lifeline" is a trademark of Heirloom Lifeline LLC. You may not use our marks without our prior written permission. (This does not affect your ownership of Your Content.)
10. Service availability and changes
We are actively building Heirloom Lifeline. Features may change, and the Services may occasionally be unavailable. We may add, modify, or discontinue parts of the Services, and we will try to give reasonable notice of significant changes.
11. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Heirloom Lifeline LLC and its members, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Heirloom Lifeline LLC from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms, or your violation of the rights of another person, including with respect to content you add.
14. Termination
You may stop using the Services at any time. We may suspend or end your access if you violate these Terms or to protect the Services or other users. Sections that by their nature should survive termination (such as content licenses already granted, disclaimers, limitations of liability, and governing law) will continue to apply.
15. Governing law
These Terms are governed by the laws of the State of Connecticut, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Services will be handled in the state or federal courts located in Connecticut, and you agree to that jurisdiction, unless applicable law gives you the right to bring a claim elsewhere.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above, and for significant changes we will provide a more prominent notice. Your continued use of the Services after an update means you accept the revised Terms.
